What are the requirements for a potential variance approval?

1. Something must be "wrong"  or "unusual" with the land related to the soil conditions, shape or topography that does not generally affect the zoning district in which it is located.

2. A literal enforcement of the provisions of the ordinance or by-law would involve substantial hardship, financial or otherwise to the petitioner and must be related to the land's unique soil conditions, shape or topography.

3. Any relief granted by the variance may not be detrimental to the public good and should not nullify or substantially derogate from the intent or purpose of such by-law or ordinance.
